1. INTRODUCTION

Welcome to Affection, a social and dating platform operated by Affection-Bolingo Inc. (“the Company”)

By accessing or using the Affection mobile application or related services (“the App”), you agree to be

bound by these Terms & Conditions (“Terms”).

If you do not agree, you must immediately stop using the App.

Affection is designed to help users create meaningful connections through curated profiles, blurred

photos, and conversation-driven matching.

2. ELIGIBILITY

To use the App, you confirm that:

• You are 18 years of age or older.

• You have legal capacity to enter a binding contract.

• You are not prohibited from using online dating or social platforms under applicable law.

• You have not been previously removed or banned from Affection.

Users under 18 are strictly prohibited.

3. ACCOUNT REGISTRATION

3.1 Account Creation

To access the App, you must create an account and provide accurate, complete, and current information.

3.2 Account Security

You are responsible for maintaining the confidentiality of your login details and all activities under your

account.

3.3 One Account Rule

You may not create multiple accounts or transfer your account to another person.

3.4 False Information

Providing false, misleading, or fraudulent information is grounds for suspension or termination.

4. ACCEPTABLE USE & PROHIBITED CONDUCT

Users agree not to engage in any of the following:

• Harassment, bullying, or hate speech

• Uploading sexually explicit, violent, or harmful content

• Impersonation or misrepresentation

• Scams, fraud, solicitation, spam, or phishing

• Stalking, abusive behaviour, or threats

• Using automated scripts, bots, or data-scraping tools

• Reverse engineering, disrupting, or harming the platform

• Sharing others’ personal data without consent

• Attempting to bypass profile or matching systems

Affection reserves the right to remove content or suspend accounts that violate these rules.

5. USER-GENERATED CONTENT (UGC)

5.1 Ownership

You retain rights to all content you submit.

5.2 License to the Company

By using the App, you grant Affection-Bolingo Inc. a non-exclusive, worldwide, royalty-free license to:

• Display

• Host

• Reproduce

• Modify

• Distribute

your content solely to operate and improve the App.

5.3 Content Removal

We may remove any content that violates these Terms or is deemed inappropriate.

6. INTELLECTUAL PROPERTY RIGHTS

All intellectual property relating to the App—including logos, branding, designs, matching algorithms,

software code, user interface elements, and features—belongs to Affection-Bolingo Inc.

You may not:

• Copy, modify, adapt, translate, or distribute the App

• Reverse engineer or decompile the App

• Use our trademarks without permission7. Arbitration and Class Action Waiver

Any dispute, claim, or controversy arising out of or relating to the use of the App shall be

resolved exclusively through binding arbitration on an individual basis, and not in a class,

collective, or representative action.

• Users expressly waive the right to participate in class actions or class-wide arbitration,

except where such waiver is prohibited by applicable law.

8. MATCHING & USER INTERACTIONS

Affection facilitates introductions but does not guarantee:

• Matches

• Dates

• Successful communication

• Safety or compatibility with other users

Users are solely responsible for their interactions, both online and offline.

The Company is not liable for:

• Behaviour of users

• User content

• Online or offline encounters

• Emotional or financial loss resulting from interactions

9. PRIVACY & DATA USE

Your privacy is important to us.

By using the App, you consent to the collection, use, and disclosure of your personal data as described in

our:

GDPR Addendum (if applicable)

These documents form part of these Terms.

10. IN-APP PURCHASES & SUBSCRIPTIONS (If applicable)

If the App includes paid features:• All purchases are processed by third-party payment providers.

• Prices may change at any time with notice.

• Subscriptions may auto-renew unless canceled.

• Refunds, if any, are subject to the App Store or payment provider’s policies.

11. Explicit User Indemnification (IMPORTANT)

User Indemnification

Users agree to indemnify, defend, and hold harmless Affection-Bolingo Inc., its officers, directors,

employees, and affiliates from any claims, damages, losses, liabilities, costs, or expenses (including

reasonable legal fees) arising out of:

• Their use of the App;

• Violation of these Terms;

• Infringement of intellectual property or privacy rights of third parties;

• User-generated content or interactions with other users.

This significantly strengthens liability protection.

12. TERMINATION AND SUSPENSION

The Company may suspend or permanently terminate your account for:

• Violating these Terms

• Engaging in harmful conduct

• Posting illegal or inappropriate content

• Misuse of the platform

• Fraudulent activity

You may delete your account at any time through the App settings.

13. DISCLAIMERS

• The App is provided “as is” and “as available” without warranties of any kind.

• We do not guarantee uninterrupted access, error-free functionality, or accurate matching results.

• The Company is not responsible for user actions, content, or interactions.

14. App Store ComplianceThis Agreement is between the user and Affection-Bolingo Inc., not Apple Inc. or Google LLC. Apple

and Google are not responsible for the App or its content.

Users acknowledge that Apple and Google are third-party beneficiaries of these Terms and may enforce

them against users.

Use of the App must comply with applicable App Store and Google Play policies.

This clause is required for App Store approval.

15. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

• Affection-Bolingo Inc. is not liable for any indirect, incidental, or consequential damages.

• This includes loss of data, emotional distress, personal injury, or financial loss arising from using

the App.

• Our total liability shall not exceed the amount you paid (if any) for accessing premium features.

Force Majeure

Affection-Bolingo Inc. shall not be liable for any failure or delay in performance caused by events

beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics,

government actions, labor disputes, internet outages, or failures of third-party service providers.

16. DISPUTE RESOLUTION & GOVERNING LAW

These Terms are governed by the laws of the Province of Ontario, Canada.

Users agree that:

• Disputes must first be resolved informally by contacting support.

• Unresolved disputes will be handled exclusively by courts in Ontario.

Class action waivers may apply depending on jurisdiction.

17. CHANGES TO THESE TERMS

We may amend these Terms from time to time.
